Copyright DVD ownership?

Hi

I have a dispute with a dvd company who filmed a music event on our behalf. The mix at present is unacceptable but the owner of the DVD company is threatening to sell the DVD through his own outlets and has ceased any further disscussions.

My question is does he have the right to do such a thing and if not how can I stop him?

The recording and reproduction of your music is something that you must authorise. Ultimately it depends on the agreement you have with the company and what you have allowed them to do this as part of that agreement.

Thanks for the reply.

We ourselves had to recieve permission from the artists management which the DVD company will not now get. There was never no agreement for them to sell any DVD's except the ones we agreed to buy off them.

I am presuming by this he has no rights?

So this is not even your own music, but cover versions?

If the permission was for performance only - then the DVD Company could be in breach of copyright. If on the other hand you obtained permission to record and reproduce as well, (for which I am certain you will have been asked to pay royalties) it is back to your agreement with the DVD company.

To me it sounds as though they are on very thin ice. If the DVD Company does not have permission form all the copyright owners of the work they cannot legally sell the DVD.
