Re: Night of the Living Dead

Thanks guys. Interestingly, as I mentioned it as an example earlier, I looked to see if anyone IS exploiting House on Haunted Hill in the UK. Turns out that they are. It is all over YouTube (which has an algorithm to spot infringement) and you can watch several versions of it (from several different...

Re: Night of the Living Dead

Ok, thanks. I suppose that the $64,000 question is...has anybody ever successfully argued either case a. or case b? I'm pretty sure I'm in the clear with Night of the Living Dead because nobody is pursuing copyright, regardless of the actual situation. It's beginning to sound like it is such a poten...

Re: Night of the Living Dead

Well thank goodness it's simple :-) Soooo...do we think that: a. The 1891 act means "reciprocity" (ie, if it is PD in the US, it is PD in the UK)? b. It means that any US movie will follow UK law regardless of its copyright status in the US (ie 70 years from death of writer or director)? c...

Re: Night of the Living Dead

Ok, thanks.
House on Haunted Hill is PD in the US due to a failed copyright renewal. How would you see that example?

Re: Night of the Living Dead

Ok, so there's no blanket rule I can apply?

I'm planning on using more PD media, so I'll come back and check.

Thanks!

Re: Night of the Living Dead

Thanks guys.

So would it follow that any film that is in the public domain in the US is fair game worldwide, or have I misinterpreted?

Re: Night of the Living Dead

Brilliant.
Thank you SO much for your detailed response.
It's so difficult to establish all of this as a layman.
Have a great week.

Night of the Living Dead

Hi All, I'm using video from 1968's Night of the Living Dead for a new movie. I know this is definitely fair game in the US as it has always been in the "public domain". My question is...does the Berne Convention apply here? Is it public domain in any Berne-adopting country? The film is pu...

Re: Advice on "public domain" please

Ahhhh....I think I have the answer. The claim is for "By the Light of the Silvery Moon/That's My Desire (medley)" ...so presumably they own the rights to That's My Desire and the algorithm is flagging up Silvery Moon in error. I'll have a look in the movies forum, but maybe you can also an...

Re: Advice on "public domain" please

Great. Many thanks.

The claim is apparently for the use of the "melody".

Re: Advice on "public domain" please

Thanks again. That's slightly odd then. I uploaded my movie to a private link on YouTube and got a copyright warning from "Polaris Hub AB" claiming copyright in Brazil, Iceland, Finland and The Philippines. From their website: "The Polaris Hub has the authority to license the rights o...

Re: Advice on "public domain" please

Thank you so much for that Andy. I'm an idiot. I meant to say "a new recording of..." Presumably that means that you have answered my question? :-) I've produced a new recording of the 1908 song, so I'm in the clear anywhere that has the same "country of origin" rule, but not in ...

Advice on "public domain" please

Hi there. I want to use an original recording of "By the Light of the Silvery Moon" (published in the US in 1908) in a movie. I understand that the copyright expires under UK law 70 years after the death of the composer (or co-composer), which is 1952 (and therefore 1st Jan 2023). However,...
