Re: Is Nighthawks really public domain?
I read that any copyright (if applicable) was not renewed, but the 50 year/70 year thing - does this make it public domain only in the USA?

Is Nighthawks really public domain?
I believe Edward Hopper’s Nighthawks is public domain. He was USA based and Wiki states the artwork is free to use, but being ok in America where he was based, how would that affect legality overseas, & in the UK?

Halloween pumpkin
I’ve searched, but maybe am not searching with the right words, but would the movie franchise, Compass, that made the original Halloween in 1978, be able to effectively own copyright on the carved pumpkin in the opening credits? I realise the artefact is perishable and obviously long gone, but the i ...

Re: Do colour choices fall uner copyright?
As a further note, I’ve tried to submit the somewhat complicated Amazon form asking for these items to be removed. I am being told ‘they can’t verify’ who I am for me to claim my ownership. Yet there’s no way of attaching a copyright agreement to prove my ownership, if you will. I’ve reached out on T ...

Re: Do colour choices fall uner copyright?
DMCA is clearly a powerful tool and I hear sites like Amazon et al are increasingly concerned with its misuse (I’ve been a victim of this myself on Etsy) - can I legally use this on my own as just a licensed reseller?

Re: Do colour choices fall uner copyright?
Thanks Andy. I’m not concerned with getting money out of these people - just getting them to stop. I guess a strongly worded email to the people infringing might be worth a try?

Do colour choices fall uner copyright?
I am an authorised seller for artwork by a film company who are based in the USA. I have recreated a well-known piece of art but with unique and different colours based on vintage cars of the period. I have now, inevitably, started to see these unique artworks being pirated and sold on Amazon USA ...

Heinrich Gogarten art
I see that a few pieces of artwork by German artist Heinrich Gogarten are in the public domain (he died in 1911) but not many and I'm a bit confused as to why not. For example, this fine piece of work 'Sunset over the Winter Forest' (1881 I think) doesn't show any result searching Wiki Commons ...

Re: Pixsy Demand - Again!
I have a situation where the image in question was on a website in development. I was trying out different images with the client before adding attribution and we ultimately went live with a different image anyway. 3 weeks later we got the demand. Pixy software found the development website somehow ...

Re: Etsy shop closed by US law firm
My own experience of Etsy is that Etsy claims complete neutrality much like eBay. Which means they comply with all DMCA notices filed and remove items, and thus cannot be held legally responsible for what is sold on its platform. It’s then up to you to either file a counter-notice if you know the n ...

Re: Seller on Etsy had claimed ownership of Public Domain art
Thanks, this has been swiftly resolved. Etsy also give the complainer’s email to allow direct contact, & I sent a no-nonsense opinion of this action to him knowing he could not possibly own the rights. He backed down immediately, & it transpired his actions were against around 20 different Etsy s ...

Seller on Etsy had claimed ownership of Public Domain art
My version of the artwork from the 1700s, John Henry Fuseli - The Nightmare, which I sell as a restored print, has been the subject of a takedown notice on Etsy from a fellow Etsy seller who has 'claimed' this Public Domain work under Etsy's 'Notice of Intellectual Property Infringement'. Under DMCA ...
