Re: Public domain but creators actively sue large companies

I did wonder on further reading if it was trademark-name related. I believe the film co has trademarked ‘Endless Summer’ as a phrase (it amazes me such 2 word phrases can be trademarked). In which case, listing a public domain Endless Summer poster for sale might infringe trademark by listing it as ...

Re: Albin Grau - Nosferatu

I am aware of Ronald Borst’s connection, but don’t believe him to be a copyright holder, though I can’t confirm that for a fact, although he may indeed own some original art. I have made some small progress in this search though, but things are right now at a very sensitive stage in my dealings with...

Public domain but creators actively sue large companies

I’m confused over the legality of being able to replicate artwork for The Endless Summer movie poster from 1966. I thought I was absolutely fine using something that is in the public domain ( https://commons.m.wikimedia.org/wiki/File:The_Endless_Summer_(1966_Cinema_V_poster).jpg#mw-jump-to-license b...

Re: Albin Grau - Nosferatu

So here I am, still attempting to find an answer to this to the point it’s become something I can’t seem to give up on. I’ve since found a family tree site that has a listing for Grau’s death including info on wife - tho the few relatives listed are deceased. I reached out to the one person who upda...

Re: Etsy shop closed by US law firm

Hi, feel free to ask any questions on here (it might help others too) & I’ll try to answer where I can: the final resulting agreement necessitated that I sign a confidentiality clause, so I’m careful of saying too much. Basically it took about 2-3 weeks from shop suspension/law firm issuing of c...

Confusion over license attribution & credit

Sometimes I read and re-read the Wiki Commons info to work out if I can use something commercially or not and still only end up about 90% certain rather than 100% certain! I think I am able to safely use this lovely Art Deco image ( https://commons.wikimedia.org/wiki/File:Lili_Elbe_by_Gerda_Wegener....

Re: Albin Grau - Nosferatu

Would restricting sales territory to selling in places other than Germany avoid that issue? Though that would be a shame to end up doing all things considered.

Re: Albin Grau - Nosferatu

I tend to find old things and digitally restore them and sell them as high quality art prints. I have a piece of Grau work which appeared as an advert in an old now defunct film magazine in Germany (1921 I believe) which I've restored to a high quality. So it would be commercial use.

Re: Albin Grau - Nosferatu

Well this is getting very frustrating. No one will even reply to my contact regarding copyright! I have reached out to the most obviously recent user, Eureka! Films, who's restored blu-ray of Nosferatu uses Grau's artwork on the cover (credited) - they have ignored my email, plus a couple of request...

Re: Albin Grau - Nosferatu

Well I am getting nowhere fast on this hunt. Various Facebook specialist groups suggested BFI as their publishing arm put out a book a few years back with Grau’s work included (sadly the author died last May). Aside from that I’m getting zero response or acknowledgment from anywhere. The fairly rece...

Re: Albin Grau - Nosferatu

Thank you, no I hadn’t checked the German wiki. Though regarding "Bayrischzell honours him to this day“, I found what I hope is an ‘official’ email for the place and have emailed asking for info. If he has no heirs, does that mean the art defaults to public domain?

Albin Grau - Nosferatu

I am trying to trace the current owner (if any) of the rights to Grau's promotional artwork for the 1922 movie, Nosferatu. I am at a loss as to where to look. research has shown me that Grau lived in Switzerland after the war and then died in his home country of Germany in Bayrischzell in 1971.The a...

Re: Etsy shop closed by US law firm

An update. Having provided my own accounting information to prove that profit from sales was under £200, the parties came back to me offering a settlement figure of less than $1,200. My counter offer was for around half that reiterating that the profit I made should be considered in this case, not t...

Re: Etsy shop closed by US law firm

The redacted complaint has now been revealed and it seems I used a photograph by a well known photographer as part of one of my old 1970s advert replications. The law firm is legitimate and is seemingly often used by music related artists. Court infomation was provided. The information also lists a ...

Re: Etsy shop closed by US law firm

Thank you for such a detailed reply. My work is varied; a bit of a scattergun approach to see what sticks and will sell. But what I thought to be a unique idea was to find old 1970-90s music paper ads for forthcoming albums, shows, singles etc and create art pieces that replicate them, all text is r...
