Re: Copyright infringement via Permission Machine, acting on behalf of Alamy

Hi giraffe and welcome,

Yes I think that a £40 counter offer would be suitable.

It is an unfortunate fact that tthe subject of a photograph, such as your friend the athlete, has no rights when it comes to copyright in the image.

Re: Fair dealing reproduction in electoral leaflets

Hi lukew151 and welcome, You would certainly be justified in using the fair dealing exception for quotation provided by Subsection 30 (1ZA) of the Copyright Designs and Patents Act 1988. However Subsection 30(1) which deals with criticism or review might be more tricky. The exact wording of the sect...

Re: Copyright Agent demanding £600

Hi again, They can in theory put forward any figure they like for the damages, if it went to court. However that would be a bad move because you could then show that they were previously demanding a lower (though still unreasonable) figure. Since the facts of the alleged wrong (tort) have not change...

Re: Copyright Agent demanding £600

Hi Helpples and welcome to the forum. My first reaction was that if $600 dollars was the original fee they wanted, when this was converted to sterling it should have been £475. But I think we both know that a nice round number is usually a sign you are probably dealing with a rip-off. I have very li...

Hi starling and welcome to the forum. The issue you raise is a complex one. As you mention it encompases copyright law and contract law, but it also includes database law and that strange variant of copyright which is unique to Britain and some of its former colonial possessions, namely Crown Copyri...

Re: Copyright infringement via Permission Machine, acting on behalf of Alamy

Hi juicysteve and welcome to the forum. It's nice to have a variation on the rather depressing theme of straightforward allegations of infringement. Going straight to your question, since the image was presumably on the website during the period of ownership by the new company, then they would be li...

Re: Pixsy demanding I pay a fee for unauthorised use of an image. Urgently need help.

Hi Les, I'm not aware of any occasions where this has happened. In theory they are supposed to disclose the name of the copyright owner (not necessarily the photographer in every case) when they send off their demand emails. This certainly has to be done as part of the pre-action protocol before lod...

Re: Posting a link with a thumbnail - infringment

hi TheTallOne and welcome to the forum. If you have not copied the image onto you site and it is only there because of a reciprocal link with the newspaper site, then there is no infringement of the image. The law on this has been clarified by the European Court of Justice on three occasions in the ...

Hi cuthbert and welcome to the forums. The short answer to your question is Yes. If you are just concerned about exploiting your music, you can stop reading. If you want to know more about the rights involved in the song as performed by the band, read on. The long answer is: From what you have told ...

Re: Summons from Illinois for copyright infringement

hi Laura, Really, from your perspective, nothing has changed. They still haven't specified what it is that they claim infringes the trade mark of their client. Nor, I suspect, have they done so for the dozens of other defendants who are listed on the same court filing. On that basis you cannot sensi...

Re: Burden of proof - pa media group

Hi ellap, and welcome to the forum, You can certainly ask for evidence that Alamy have authority from the copyright owner to follow up on claims of infringement, and no doubt if they haven't done so already, they will also be able to provide a screenshot showing the disputed image on your website re...

Hi Nick and welcome to the forum. As you probably appreciate, if the individual contributions made by you, Pete and Dave cannot easily be separated, you are considerd as joint authors, irrespective of the actual contribution of each of you. While it is not relevant to your query, joint authorship br...

Re: PicRights "infringement"

Hi Highland, In the absence of any support from the hotel, have you also tried contacting any of the other users you mentioned in your first posting? What you are looking for is anyone who can back up your experience of using the site in the good faith belief that the hotel owned the copyright or we...

Re: PicRights "infringement"

Thanks for the clarification. I would suggest contacting the hotel and ask about the provenance of the particular image or images concerned. It certainly sounds, from what you have posted, as if they are claiming either ownership of the copyright or an exclusive licence in them, since they are effec...

Re: PicRights "infringement"

Hi Highland and welcome, Copyright infringement is a matter of strict liability which means that even if you acted with a good faith belief that the image was provided with a free licence, you could still be liable. However there is a strong argument that you were authorised to use the image by the ...
