Re: Copyright Agent / Alamy alleged infringement

Hi Fej123 and welcome to the forum.

If you run your website in a similar way to a forum in that you allow members to directly upload their own material without any prior editorial intervention from you, then you enjoy what is known as safe harbour protection. This comes from both the US Digital ...

Re: Copy Track

Hi Jo,

I can't answer your question about whether Yayimages or Raschma is the current owner of the copyright in that image, but I would be surprised if a freelance photographer would sign over his/her copyright in return for microstock payments. And in the other cases where the photographer has ...

Re: Copy Track

Hi Jo and welcome to the forums,

The demand is based on their assumption that you don't have a licence to use the images, and this would be easily countered by giving them the details of any licence you did hold, but I assume from the way that your posting is worded, you don't have the correct ...

Re: Copyright infringement claim from Rights Control - Science photo library

Hi kajaja and welcome to the forum,

'Correct' is not the word I would use.

If you read through this and some of the other threads here involving companies like PicRights and Pixsy (to name but two) you will see that the amount being demanded from you is totally disproportionate and will be many ...

CopyrightAid (the site admin) can tell you more details, but I understand it was a sort of DDOS attack.

Re: PA Media/time limit for copyright infringement claims

As I explained in my answer to you in your Copy Track thread, I can't quote any statute law because the principle of civil restitution is based on both common law and equity. I pointed to you a source, namely the section headed Remedies on page11 of this pdf entitled an Introduction to Civil ...

Re: Copy Track

All your BTW points at the end are why we encourage people to challenge these claims companies. Some companies are indeed sketchy and don't do any due diligence, which encourages chancers to sign up to use their services. This is a world away from genuine photographers like members snappman and ...

Re: Statute of Limitations on copyright infringement/fair useage

I am gratified that you feel the need to expand my understanding of the Limitation Act 1980.

However the parts of DIstrict Judge Richard Vary's judgment in Agripicture Images Limited v Telegraph Media Group Limited which you cited do not involve an interpretation of the Limitation Act, but rather ...

Re: Statute of Limitations on copyright infringement/fair useage

Snapperman slightly misstates how the Limitation Act works. Section 2 says 2 Time limit for actions founded on tort.

An action founded on tort shall not be brought after the expiration of six years from the date on which the cause of action accrued. In layman's terms this means that the 6 year ...

Re: Can I sell a product enhancer

Hi Bogracs and welcome to the forum,

It's important to identify here which intellectual property rights might be involved in your product. Copyright is not one of them. They are primarily design right and trade mark rights.

There is no issue with an item which modifies an existing item provided ...

And if further proof was needed that easyGroup are particularly litigious, here is the Court of Appeal's recent judgment in another case brought by them. This case was against EasyFundraising Ltd, although for reasons explained in the judgment, it also involves a second case, easyGroup Ltd v Easy ...

Re: Threatened opposition to trade mark

Following on from my earlier post, you may find this recent judgment interesting. The case involved a similarly litigious large company and a dispute over the use of a fairly common word: easyGroup Ltd v Premier Inn Hotels Ltd
TL;DR easyGroup lost the case.

Re: Transformative Artwork Legislation

Hi Man123 and welcome to the forum,

The UK doctrine of Fair Dealing doesn't contain anything which equates to the US concept of transformation. The grounds for claiming fair dealing are relatively restricted, namely for criticism or review, private research, and the three newer categories of ...
