I think I found my answer, but it would most likely be the Trade Descriptions Act 1968 and CDPA 1988 . Yeah basically he is trading off my goodwill and deceiving customers into thinking they're getting my item. I've sent off a legal letter to them and warned that any negative reviews that are writte...

Counterfeiting

Another month, another infringer trying to ruin my business. Infringer number 6. Using my product listing on Amazon to list their own product. I manufacture a product which has my business name in the title of the Amazon product listing..."Acme plain red car seat cover" My product is currenty the be...

Thanks for the information. He started off by taking two "surface decorations" and making substantially similar versions of them. Once I sent him infringement notices, he removed them and copied the product range instead. Hypothetical example. We both design car seat covers. I have a leopard skin, f...

Imitating a product range

I recently sent copyright infringement notices to a seller who was producing a similar type of car accessory based on my surface design. He removed them claiming that it was a co-incidence (unlikely), however he is now imitating my product range. He has several surface designs which match my product...

The original company got back to me about using their fabric for producing products. They didn't mention the fabric I enquired about, but stated this for one of the fabrics in the range: "MANUFACTURERS MAY NOT PURCHASE the Flower Fairies Collection. THIS IS A LICENSED COLLECTION AND MAY NOT BE USED ...

Thanks for the information. I had an idea this morning to use the famous Burberry fabric on a product. I'm confident that the material is genuine, but I'll assume that I could not use the word Burberry in the item title? Eg. Cushion Cover Cream Tartan Burberry Fabric for Chavs. I would assume that B...

Fabrics and producing products.

I have purchased some fabric with the intention of producing a product for resale. The material has copyright notices and I would like some advice about possible copyright infringements. I'm aware of the tabberone copyright and trademark battles in the USA and how they successfully defended themselv...

The amount of infringers has now risen to three people. I've sent these people copyright infringement notices along with an invoice for profit lost x the amount of items they were intending to sell...I probably shouldn't have sent an invoice for intent, but on past sales? Infringer 1...removed items...

I doubt this would be a problem. Look at your yellow pages directory and I'm sure you will find a host of businesses with the same name. But you have three words in your business name not one!

eBay veRo program

In another thread I've reported problems with a number of ebayers taking my designs and selling them in direct competition. My problem is that despite reporting the infringements and signing a Notice of Claimed infringement, ebay have yet to get back to me. This has been going on for weeks. Should I...

I would go with a cease and desist letter as a first line of attack. There is no reason why you cannot require that they stop selling copies of your product - this is after all an unauthorised reproduction of your work (i.e. a copyright infringement). ................... Another (and/or) option may...

I've contacted ebay, but have had excuses from them about not receiving faxes. I got a reply eventually asking me to email the veRo tem directlly with Notices of Claimed Infringement, but they still haven't accepted me into the veRo program. I'm getting annoyed by this due to the amount of copy arti...

Thanks, I suppose it's in their interest to pay the invoice to avoid unwanted scrutiny by Trading Standards and a legal case involving copyright infringement for financial gain. There's no accidental infringement here. Not sure if I mentioned this earlier, but the infringers have a massive catalogue...

With regards to passing off, my product is prominent on Amazon, ebay, google product search and organic results. I supply them wholesale to a prominent accessory shop and are featured on blogs and review sites. They are sold in retail packaging and have barcodes assigned to them. The idea is quite u...
