Re: Plagiarism of Blog Articles

I completely agree Andy. The smaller cases are the ones which are the most relevant to the situations most photographers will find themselves in. And as you say there is next to nothing out there. I suspect potential infringers probably believe court action is improbable on that basis alone (and tha...

Re: Plagiarism of Blog Articles

I can confirm the Defendant has now paid his debt in full. Somewhat outside of the timescale stipulated by the Court, but just within the month beyond which I would have started enforcement. Pleased this one is over. Thank you so much for your support, I've learned a lot and wouldn't hesitate to do ...

Re: Timescales for IPEC Small Claims Track Cases

Thank you Andy - I hadn't even thought of the press! I'm guessing the defendant probably hadn't considered that possibility either.

Re: Timescales for IPEC Small Claims Track Cases

Indeed, Andy! Given this defendant's mindset so far, he seems to be of the position that he shouldn't have to pay. I'm currently preparing for that possibility. I'm still amazed that as a business owner with a busy studio, he has risked his reputation like this. Refusing to pay (it that should happe...

Re: Timescales for IPEC Small Claims Track Cases

The Judgement has just arrived in the post - exactly a month since the hearing. It looks like the court has improved the backlog. The Order is brief, just a simple summary of quantum and details of the parties. The defendant has been given 14 days to pay his debt.

Re: Timescales for IPEC Small Claims Track Cases

Thank you Andy, that's extremely helpful. So for now I need to just wait for the judgement order to arrive before I can start thinking about getting paid (no matter how long it takes to be sent out by the court) after which an enforcement order of some sort would be the next step if he doesn't pay. ...

Re: Timescales for IPEC Small Claims Track Cases

I’ve been giving some further thought to the collection period today. Whilst in the courtroom I was told that I can communicate the result of the hearing to the defendant. That makes sense, given that we are litigants in person and we are expected to share information relevant to the case. If the co...

Re: Plagiarism of Blog Articles

Thank you Andy, I'll be sure to carefully word any reference I make to the case.

If necessary I will update this thread with respect to payment, given how entrenched the defendant is in his resistance to the financial aspect.

But in the meantime, on to the next one .....

Re: Plagiarism of Blog Articles

I was in court this morning and I now have my judgment. Incidentally, there was just the Judge and myself. The defendant didn't turn up but 10 minutes into the proceedings the Clerk entered and handed the Judge an email which had just come through from him. The Judge read the contents of the email t...

Re: Timescales for IPEC Small Claims Track Cases

I had a chance to ask about the judgment situation this morning. As we know, the judgment runs from the date the judge decides the case and the person who has to pay is given so many days ( in my case the judge has given him 14 days to pay). However the judge said because there is a bit of a backlog...

Re: Timescales for IPEC Small Claims Track Cases

Hi Fatty, oh dear that's not good. So many people have told me the place is chaotic. I am dreading it a bit, and I'm leaving for court within the next hour. I will update later.

Re: Plagiarism of Blog Articles

Hi Andy, yes if he just wanted to provide 'helpful material' he could simply have directed them via a link to the article on my website (which he did do after his infringement was called out). His statement implies he was using my article to supplement the training which takes place at his studio, f...

Re: Plagiarism of Blog Articles

Thank you Andy - that's good news because I'm going to need extra time .... On re-reading the lengthy recent defence (which I got late, 2 days ago) I am discovering new things. The defendant has now said his studio is used by other photographers and for training students, and my article was intended...

Re: Plagiarism of Blog Articles

I was wondering if somebody would be kind enough to indicate how long I will be given to read out my summary of Claim at the final hearing. I've tried to condense it as far as possible but It's almost two sides of A4 and takes 5 minutes to read out. I've included the pre-action steps I went through ...

Re: Plagiarism of Blog Articles

Thank you for the reassurance Andy. I feel he's straying into the realms of defamation now. He had no time to reply to my pre-action communications yet has found the time to put together the most ludicrous defence I've yet seen. He is admitting the plagiarism but insisting he will not pay as accordi...
