Hello,
I work for a huge american company as customer service adviser and on my own initiative I am making a documentary of an internal project. I have taken the photographs and the editing also is mine and as music I wanted to put two Garage band loops (Apple free music app) and 1 piece (using around two minutes of a 7 minutes long track) of DJ Frankie Knuckles. I have no intention to publish it, as it will be to show only to the people that participated in the project.
Am I ok to use this music?

Thank you

Hi Paolasono,
2 minutes out of a 7 minute track would amount to a substantial part of the Frankie Knuckles track and so that would amount of infringement if you used it without permission.
Although you may not be publishing this video to the public as a whole, the fact that you are making it available to work colleagues is still enough to take this work outside the exception which might have applied had this just been a private piece of research or study.
So on that basis, I would advise against using the Frankie Knuckles track, unless you obtain a licence.
I suspect that the Apple free music app may also have some terms and conditions attached to it which might cause problems, but I can't be certain. Check and t&c's which come with the app, or on the Apple site, to see what they say about re-publishing.

Thank you AndyJ that was very useful; I must admit I decided not to use Frankie Knuckles tune any more but I will have to investigate with Apple if I am ok to use Garage band's loops

Hi, just to keep informed in case somebody wants to use Apple loops for their work:

The GarageBand software license agreement says:

"GarageBand Software. You may use the Apple and third party audio loop content (Audio Content), contained in or otherwise included with the Apple Software, on a royalty-free basis, to create your own original music compositions or audio projects. You may broadcast and/or distribute your own music compositions or audio projects that were created using the Audio Content, however, individual audio loops may not be commercially or otherwise distributed on a standalone basis, nor may they be repackaged in whole or in part as audio samples, sound effects or music beds."
