Personalising supermarket clothing to re-sell

Post by ABull »

Is it legal to buy baby clothing from a supermarket, print a baby's name or quote on the item and then re-sell it?

Hi ABull,

Yes that's fine. Once you've bought the item something called the exhaustion of rights applies to the clothing, which means that the maker's rights to distribute that item have been extinguished and you are free to alter it as you wish and sell it on. Applying a short quotation, would be permitted by the fair dealing exception for quotation (section 30 (1ZA)) and you wouldn't need to credit the author as the circumstances would not make this possible.
