Definition of 'employee'

Could someone please define the term 'employee', as used in the Copyright, Designs and Patents Act 1988 ?

Am I correct in thinking that a freelance worker is regarded as an employee, under the rulings of the act, unless otherwise stipulated in any specific job contract.

I'm particularly concerned with how this relates to the author's right to be identified as the author or director of the work, as stated in Section 77 of the Act.

An employee is someone who is directly employed by the business.

Someone working on a totally freelance basis would not be classed as employee. In such cases the assignment of rights should be dealt with in the contract of service.
