Photograph taken from inside Rockefeller Centre

Hi, I have a photograph I took from inside the Rockerfeller building. It basically consist of a window with a couch infrot of it and the view from the window is dominated by the empire state building.

As it was taken in the Rockefeller building, can I sell this image or do I need permission?

Hi Paul,

You don't say where you live, but if it is the USA and that's where you would want to sell this image from, then chances are that you would need a thing called a property release from the Rockefeller building. The Empire State is fine because you only photographed that from the outside. Take a look at this link to the American Society of Media Photographers website for more details.

On the other hand, if you are based in the UK and want to publish the photograph from here, there are no legal issues to prevent you. However if an advertising agency or similar body wanted to use your image for anything other than editorial use, they would probably insist on a property release because that is the norm for their industry. If anything, it would only have been the terms of entry to the Rockefeller Center which if they prohibited* the taking of interior photographs without permission, might have been violated, but since you are no longer in the building, there's not much they can do about it, and it doesn't affect the copyright in or legality of, your photograph.

*Given that the Center is promoted as tourist destination, taking photographs for personal use would almost certainly be all right. However it may be that commercial photography might require a special licence. Unfortunately the Rockefeller Center website does not include the terms and conditions for entry to the complex, so I can't check if this is the case.

Thanks AndyJ, brilliant as ever. I live in the UK, I'm going to ask them if a license is necessary to sell prints.
