Football teams

Post by stew »

Hi, I am in the process of producing a football quiz book/ puzzle book as a commercial venture. Each club would have its own headed section ( Arsenal, Manchester United etc ) . Would there be an infringement of copyright/ trade mark in using these names even without the club badge or logo? Also is it permissible to use the terms ' Premier League' & ' Championship' or is licence required from the FA & The Football League?

Hi stew,

What you propose will be OK because even if copyright applied (it doesn't to names) or the words were registered as trade marks (they may very well be) you would be using them as facts and not in the course of trade. This is entirely permissible.
If you think about it, you have already used some of the words in your question here, in much the same way they would appear in your book. Clearly you instinctively knew that was OK, but without realising it would be the same for your book.
Advice or comment provided here is not and does not purport to be legal advice as defined by s.12 of Legal Services Act 2007

Hi Andy, thanks for clarifying that...one less obstacle. Much appreciated.
