'Free' eBooks

I have an eReader device and have noticed that some authors/retailers are offering free ebooks for download from the US. Presumably they believe providing a free sample of the author's work, will stimulate sales.
What is the copyright situation if a download is made to the UK?

There is no problem provided the free sample is distributed with the copyright owner's consent.

Only the copyright owner has the right to authorise reproduction and distribution of their work. So long as this is a legitimate reproduction I can't see that there would ever be a problem - or am I misunderstanding your question?

How would you know who owns the copyright? One might assume that it How was the author but could it not be the Publisher. Is it up to the downloader to establish that?
