Usage of copyrighted logos & images to advertise/propose business with the copyright owner

I am looking to start a business relationship between myself/my company and another 3rd party company, Im planning to make a proposal document that makes use of their companies imagery and logos to give a clear indication of what I am offering. This document would only be used to advertise my services to this one company.

Would this kind of use cause issues with copyright law and open an avenue to having legal measures taken against me?

This would theoretically amount to infringement as you would be copying these images without permission. I can't see any of the fair dealing exceptions being sufficiently flexible to accommodate what you want to do. It would therefore depend on the attitude of the company to whom you are pitching the idea whether they wished to do anything about the infringement. Pragmatically speaking, I doubt if this would lead to any kind of legal action.

I suggest you pave the way by outlining your intention to make the proposal and its form to them in advance and getting an implied permission if they say they are interested.

Hi Andy

I was hoping to have the proposal be the first knowledge of my company offering my services. Like you said though I think it best if I seek permission to at least use the imagery before hand in order to avoid any issues and ruining a potential relationship.

I did consider the practicality of the company bothering to do anything about an infringement under the circumstances but that said, I going to take your advice.
