Reselling a product

What are the legal rules around reselling of a product.

An example:
1) I buy a pack of 3 pens for £5
2) I split this pack and sell individually for £6 each

None of the packaging on the item says these can't be resold or not for individual resale.
No logo's are being used of the manufacture - so no trademark issues.

What are the legal rules around buying, splitting and reselling?
