PA Media again

Post by TheBigK »

Like many others, I've got emails from PA Media chasing me for costs for copyright infringement.

My situation is that I've got a non-commercial website that has scans of football programmes for other collectors and fans to view.

One cover from a 2002 football programme included an image that PA Media own. It wasn't the only image on the page but they are chasing me because I scanned this programme cover for my website.

I do wonder if this correct because the club/printers that produced this programme must have licenced the image from PA Media when they designed and printed the original programme back in 2002. It seems to me, that if I have infringed copyright, it would be the owner/designer of the programme rather than PA Media. Perhaps someone could help me understand this better?

I have also refused to pay PA Media's costs as they are grossly unfair and unreasonable. The image is available at Alamy for just £35. They have discounted their original charges but refused my offer to settle for the cost of the Alamy charge. The issue has been running for several months now and I have received emails which seem to follow the same format as others have documented on this forum.

Hi, first time poster/newbie so apols for not being fully up to speed.
Just wanted to add to your post.
In our case we shared an article from a local newspaper, in its entirety, onto a business facebook page, from there it went automatically to a business website. In each case, in its entirety. It was a warning about traffic, intended to help customers. No financial gain whatsoever.
The article had a photo embedded, but the photographer was credited. There was an option to “share” on the newspapers website. Someone said elsewhere that feels like entrapment.
This article was shared in 2022!!!
Last week in came the emails about copyright licensing and infringement etc from PA Media Group InfringementsTeam
We took advice from FSB Legal Team and decided to pay the fee, although I believed it to be unfair, the legal team said there is insufficient UK Case Law on this to fight it and it would cost me a fortune to do so. They said they feel someone will take this to court soon, and win, then the case law will exist.
I paid by BACS. The payee was Alamy.
Within seconds I received a phone call from my Banks Fraud Team.
They have stopped the payment as they are concerned about the legitimacy. They advised me to report the email as a Phishing Scam.
I hope the bank are correct. I have advised the Copyright Infringement Emailers to send me proof of their legitimacy.
